Terms and Conditions of Service

These Terms and Conditions (“Agreement”) constitute a legally binding agreement between Vextara (“Vextara”, “we”, “our”, or “us”) and the customer (“Client”, “you”, or “your”) for the provision of pest control services (“Services”). These Terms prevail over any other documentation or communication, and acceptance of a booking constitutes full agreement.
1. Definitions
1.1. “Services”: Includes but is not limited to general pest control, visual inspections, internal and external pesticide applications, baiting, dusting, gel placements, and advisory recommendations.
1.2. “Premises”: Refers to the residential or commercial property at which Services are conducted.
1.3. “Treatment Zones”: The areas, interior or exterior, explicitly or implicitly treated by Vextara.
1.4. “Visual Inspection”: Non-invasive examination limited to visible and accessible areas without moving furniture or dismantling fixtures.
1.5. “Pests”: Includes general domestic and commercial pests such as ants, cockroaches (excluding German cockroaches unless specified), spiders, silverfish, wasps, rodents, etc.
2. Service Access and Booking
2.1. A Service booking is deemed accepted when confirmed via phone, email, website, or SMS.
2.2. The Client must provide uninterrupted access to all relevant areas at the scheduled appointment time.
2.3. With express verbal or written consent, Vextara technicians may access all internal and external areas, including roof voids and subfloors, provided safe and legal entry is possible.
2.4. Services are scheduled based on availability and may be subject to change in cases of force majeure, including weather interference.
3. Pre-Service Client Obligations
3.1. The Client shall ensure the following is completed prior to attendance:
a. All windows and external doors are closed.
b. Pets are restrained or removed from treatment areas for a minimum of 3–4 hours.
c. Fish tanks and outdoor ponds are fully covered, and internal filters turned off for the duration of treatment.
d. Pet bowls, children’s toys, clothing, and cooking equipment are removed from perimeters and relocated indoors.
e. The technician is informed of any access limitations, allergies, or chemical sensitivities in advance.
4. Post-Treatment Restrictions
4.1. Internal areas treated with surface sprays must not be cleaned, mopped, or otherwise disturbed for a minimum of 7 calendar days.
4.2. Specifically, no cleaning may be conducted on skirting boards or within a 10–15 cm radius surrounding them.
4.3. External surfaces (doors, windows, eaves) should not be washed or hosed down for at least 14 calendar days following treatment.
4.4. Violation of these conditions constitutes non-compliance and will void all service warranties issued.
5. Weather Policy
5.1. Vextara reserves the right to proceed with treatment in conditions of light or intermittent rain.
5.2. In cases of heavy downpour, the external service component will be rescheduled, while the internal component will proceed.
5.3. No additional call-out fee shall apply for the return visit unless service scope is modified by the Client.
6. Payment Terms
6.1. Full payment is required on the day of service completion, unless otherwise stated in writing.
6.2. Accepted payment methods include:
a. Cash
b. EFTPOS (Visa, Mastercard)
c. Direct bank transfer
6.3. Vextara does not apply surcharges to standard domestic card payments.
6.4. Overdue invoices beyond 7 days may be referred to third-party debt collection, and the Client agrees to indemnify Vextara against all associated legal and administrative recovery costs.
7. Warranty & Guarantee
7.1. Warranty is property-specific and must be discussed with the attending technician.
7.2. A general pest control service may qualify for up to 6 months limited warranty, conditional upon:
a. Compliance with pre- and post-treatment guidelines
b. No disturbance of treatment zones
c. Environmental factors remaining stable
7.3. The following conditions do not carry warranty:
a. Bed bug infestations
b. German cockroaches, unless treated under a specialist Vextara control program
7.4. Warranty may be voided if:
a. The property is exposed to reinfestation from adjacent structures
b. Hygiene, clutter, or poor housekeeping remains unresolved
c. Treatment instructions are not followed precisely
8. Pest Behaviour and Follow-Up
8.1. The Client acknowledges that increased pest activity is expected within 0–14 days post-treatment, as pests are flushed out.
8.2. Residual products continue working throughout this period. Clients are advised not to interfere or assume treatment failure during this interval.
8.3. Follow-up visits, where applicable, will be discussed with the technician and may form part of a longer-term control strategy.
9. Inspection Limitations
9.1. Inspections are visual and non-invasive.
9.2. The technician is not obliged to move furnishings, fixtures, or enter sealed spaces unless otherwise contracted.
9.3. Any structural, timber, or termite assessments are excluded unless explicitly listed on your quote.
10. Documentation, Reports & Media
10.1. Technicians may document treatment with photos or internal service reports for compliance, QA, or internal audit purposes.
10.2. No photographic materials will be used in marketing, advertising, or training unless written consent is provided by the property owner or their agent.
10.3. Safety Data Sheets (SDS) and product information are available upon request or through our digital SDS register.
11. Compliance and Regulatory Obligations
11.1. All chemicals are registered with the Australian Pesticides and Veterinary Medicines Authority (APVMA).
11.2. Vextara operates in compliance with all NSW WHS regulations, including use of PPE, signage, and label-specific protocols.
11.3. The Client agrees not to impede the technician’s lawful compliance obligations during service delivery.
12. Limitation of Liability
12.1. To the maximum extent permitted under the Competition and Consumer Act 2010 (Cth), Vextara disclaims liability for:
a. Consequential, indirect, or incidental loss or damage
b. Re-infestation arising from external sources or property design defects
c. Damage to property caused by Client negligence, refusal to follow recommendations, or obstruction of service
12.2. Where liability cannot be excluded, Vextara’s total liability is limited to:
a. The re-supply of the service; or
b. A refund of the service fee paid
13. Privacy
13.1. Vextara collects, stores, and processes data in accordance with the Privacy Act 1988 (Cth).
13.2. Client data is used only for the provision of services, invoicing, and essential communications.
13.3. No data is shared with third parties outside those required for lawful processing or debt recovery. See our Privacy Policy.
14. Force Majeure
14.1. Vextara shall not be liable for delays, failure, or damages resulting from events beyond its reasonable control, including but not limited to natural disasters, pandemics, labour shortages, supplier interruptions, or adverse weather conditions.
15. Governing Law
15.1. This Agreement is governed by the laws of New South Wales, Australia, and all parties submit to the jurisdiction of the courts of NSW.
16. Revisions
16.1. These Terms may be updated at any time without notice. The current version will be published at https://vextara.com.au/terms-and-conditions and shall apply to all future bookings.
